Terms of service

What you are agreeing to when you book lessons — including the parts most schools leave off the website.

These terms

These are the terms you agree to when you take lessons with Clearway Driving School Ltd, company number 08012447, Office 4, Winwick Street, Warrington, WA2 7TT.

What you must have

  • A valid provisional licence, which we must see before the first lesson. No licence, no lesson.
  • Eyesight meeting the legal standard — reading a number plate at 20 metres, with glasses or lenses if you wear them. Bring them.
  • To have told the DVLA about any medical condition that affects driving. That obligation is yours and we cannot check it for you.
  • To be fit to drive at the start of every lesson. See below.

Booking and cancelling

Lessons are usually a regular weekly slot. Cancel or move one with more than 48 hours’ notice and there is no charge.

Inside 48 hours the lesson is chargeable, because the slot cannot realistically be filled. We will waive it for genuine illness or an emergency, and we do not ask for proof.

If we cancel — illness, a car off the road, weather that makes teaching pointless — you are not charged and we will offer the earliest replacement we have.

Paying and refunds

Pay lesson by lesson or in blocks of ten at a small saving. There is no joining fee and no minimum commitment.

Unused block hours are refunded on request, at the single-lesson rate for hours already taken. If you move away, stop, or decide this is not for you, you are not locked in.

Fitness to drive

We will end a lesson immediately, and charge for it, if we believe you are unfit to drive. That means alcohol, drugs including prescribed medication that impairs you, or being too tired to be safe.

It is not a judgement about you. An instructor who lets an impaired learner drive is committing an offence and risking somebody’s life, so there is no version of this we are flexible about.

Booking the test

We will recommend booking a practical test when a mock test indicates you are likely to pass. You are free to book earlier against our advice, and plenty of people do.

If you do, we will still teach you and still take you, but we may decline to provide the car where we believe the attempt is clearly premature. We will say so in advance rather than on the day.

Using our car for the test

Included when you have taken lessons with us and we have agreed you are ready. Normally an hour before the test and the test itself.

The car is insured for the test. If you fail, the insurance excess is not charged to you unless there has been damage caused by something outside normal driving.

The DVSA test fee is separate and payable by you. We will book it with you rather than for you, so the booking stays in your name and your control.

What we will not do

  • Teach anybody without a licence check. Including for one lesson, including if you have forgotten it and are certain you have one.
  • Provide the car for a test we believe is clearly premature. We will tell you well in advance.
  • Continue with an instructor relationship that is not working. Say so after two lessons and we will move you at no charge.
  • Teach in conditions we judge unsafe — ice, flooding, or fog. You will not be charged for a lesson we call off.

Our liability

Our cars carry full tuition insurance. Where an incident occurs during a lesson and you were following instruction, it is our responsibility and our insurance.

We do not accept liability for a test failure, for DVSA fees where a test is cancelled or rescheduled by them, or for loss that was not reasonably foreseeable. Nothing here limits our liability for death or personal injury caused by negligence, or for anything else that cannot lawfully be limited.

Your consumer rights

Nothing here removes your legal rights. Under the Consumer Rights Act 2015 a service must be carried out with reasonable care and skill, within a reasonable time, and for a reasonable price where none was agreed. If something falls short you are entitled to have it put right.

Complaints and governing law

Speak to your instructor first — most things are sorted in a conversation. If not, put it in writing to the address above and we will respond within 14 days. These terms are governed by the law of England and Wales.
